Términos y Condiciones de Contratación
Objeto del servicio: Wircos proporciona una plataforma que es una pasarela de pago entre el creador y el potencial comprador de un contenido digital, facilitando el proceso de compra.
Registro de contenido: el creador de contenido puede subir a la plataforma de Wircos tanto archivos como desee para el registro de contenido digital. Dichos archivos se custodian en los servidores de Wircos hasta que un comprador decide comprarlo. Los servidores de Wircos cuenta con un sistema de custodia y seguridad.
Una vez subido el archivo/s que constituye/n el contenido, el creador obtendrá un enlace que podrá compartir en su página web y redes sociales para promocionar y vender su contenido digital.
Con el fin de no generar gastos en la creación del contenido, la plataforma de Wircos se basa en el minado bajo demanda por lo que únicamente se “minará” el contenido digital en el blockchain una vez comprado por el comprador que asumirá los gastos de dicho minado para que el registro del contenido resulte gratuito para el creador.
Proceso de compra del contenido digital: el comprador podrá adquirir el contenido a través del enlace facilitado por Wircos en el momento de subir el archivo por el creador. Mediante dicho enlace, el comprador tendrá acceso a una plataforma de pago a través de la que podrá realizar la compra mediante el pago con tarjeta de crédito o débito o cualquier otro método de pago que se ofrezca. Una vez recibido y comprobado el pago, el comprador recibirá el acceso al contenido digital.
Responsabilidad del comprador: el comprador será responsable de que los datos personales que proporcione durante el proceso de compra sean veraces y actualizados. Asimismo, también será responsable de cumplir con las leyes y regulaciones aplicables al uso de la plataforma y a los contenidos adquiridos.
Propiedad Intelectual: El Usuario reconoce y acepta que todos los contenidos que se muestran en el Espacio Web y en especial, diseños, textos, imágenes, logos, iconos, botones, software, nombres comerciales, marcas, o cualesquiera otros signos susceptibles de utilización industrial y/o comercial están sujetos a derechos de Propiedad Intelectual y todas las marcas, nombres comerciales o signos distintivos, todos los derechos de propiedad industrial e intelectual, sobre los contenidos y/o cualesquiera otros elementos insertados en el página, que son propiedad exclusiva de Wircos, que tiene el derecho exclusivo de utilizarlos en el tráfico económico. Por todo ello el Usuario se compromete a no reproducir, copiar, distribuir, poner a disposición o de cualquier otra forma comunicar públicamente, transformar o modificar tales contenidos manteniendo indemne a la empresa de cualquier reclamación que se derive del incumplimiento de tales obligaciones.
Limitaciones de responsabilidad: la plataforma no se hace responsable de ningún daño o pérdida que el comprador pueda sufrif como resultado del uso de la plataforma o de los contenidos adquiridos. El comprador, asimismo acepta que la plataforma no será responsable en caso de fallos técnico, interrupciones, retrasos o cualquier otro problema relaciona con el procesamiento de pagos y ajenos a Wircos.
Política de Devoluciones: en caso de que el comprador no esté satisfecho con el contenido adquirido, la plataforma no aceptará devoluciones ni reembolsos, salvo que exista causa justificada.
Modificación de las condiciones: la plataforma se reserva el derecho de modificar las condiciones generales en cualquier momento, previa notificación genérica a los usuarios de la misma.
Ley aplicable y jurisdicción: las condiciones generales se regirán por la ley española y cualquier disputa que surja en relación con ellas será sometida a los tribunales que por ley correspondan.
